Code of Families: With Cuban Flavor and Aptitude for the Future

The Commission created to prepare the draft of the “Family Code” held a new working meeting at the Palace of the Revolution, leaded by the First Secretary of the Central Committee of the Party and President of the Republic Miguel Díaz-Canel Bermúdez.

After intense days of debate during the months of June, July, and August, in this Monday's exchange, where Prime Minister Manuel Marrero Cruz also participated, the twentieth-second version of the draft of this important legal norm was assessed and approved.

“One of the main decisions the Commission adopted was to provide information to the population of that version of the Family Code, because now a phase of the so-called specialized consultations will begin, within a set schedule. The approved version will be known to all our people, because it will allow us to get opinions, as well as that the entities, organizations, agencies where these consultations are going to take place, in greater detail, study it, understand it and give their opinion" commented to the press the Minister of Justice Oscar Silvera Martínez.

After participating in the successful exchange, the Justice official considered that this step opens a significant path in the elaboration of the new Code of Cuban families.

In this regard, he explained that “from that moment on, a new version of the draft would be approved and submitted for debate, as a result of this process of consultation, dialogue, and debate. Then we would be in a position to present it to the National Assembly for the analysis of the deputies, for the future approval of a project that will be the one that will be submitted by mandate of the National Assembly to a process of popular consultation, after that a new approval by the National Assembly, and the determination of the moment of the popular referendum for its approval by the people”.

The path followed in the drafting of this legal norm is complex, but also necessary, assured the Minister of Justice.

"This path is vital for success and quality, for the sturdiness of a legal norm such as the Family Code due to the importance it has in our society," said Oscar Silvera Martínez.

Family Code, with a Cuban flavor and vocation for the future

The members who make up the Commission for the elaboration of the “Family Code” project, offered their evaluations about the fundamental contents contained in version No. 22 of an essential text for Cuba, with a profoundly Cuban and Latin American seal of identity; based on paradigms of inclusion and non-discrimination; modern, with aptitude for the future, in tune with the socio-family reality; and with a language available to all, as described by Ana María Álvarez-Tabío, a professor at the Law School of the University of Havana.

 For his part, another scholar on the subject and member of the Commission, the President of the Cuban Society of Civil and Family Law Leonardo Pérez Gallardo, affirmed that each family is a different story and the new code that is elaborated in Cuba must match its time.

“The Family Code is one of the most important veins in the bloodstream of society, and the Cuban family is a family in which values ​​are exalted, hept, and idiosyncrasy and culture play important roles in them. What this Family Code intends is that we all be included”, said the expert.

During the meeting, the President of the Republic Miguel Díaz-Canel Bermúdez insisted on the importance of this project being widely consulted in the most varied areas of society.

“Young people must be consulted, because they are going to form the families of the future, there must also be the criteria of jurists, representatives of different social sectors, making the consultation as broad as possible, so that what is presented to the National Assembly and to the popular consultation be as complete as possible”, highlighted the Head of State.

At the meeting, where the provinces of Matanzas, Santiago de Cuba, and Guantánamo were represented via videoconference, President Díaz-Canel also stressed the need for the most recently approved version of the "Family Code" project, be made known and explained to the population through the most varied channels the country has, ranging from media, agencies, and institutions.

The importance of developing a modern and inclusive Family Code, which responds to all constitutional precepts and which really constitutes an advance in the conception of families in Cuba, was ratified this Monday, during a new meeting of President Díaz-Canel with the members of the Commission in charge of preparing the draft of this transcendental legal norm, which will soon be submitted to popular consultation.
